09 Nov Compliance With Atmospheric Emissions License
An Atmospheric Emissions Licence (AEL) comes with a list of legal conditions which the Holder is responsible to comply with.
Compliance must be audited by an external environmental practitioner at least once a year. The completed report of such audit must be submitted to the Licencing Authority not more than 30 days after completion.
Failure to comply with any of the AEL conditions and requirements is a breach of the licence conditions, and the Licence Holder may be subject to the sanctions set out in Chapter 7, Section 52 of NEM:AQA (Act No. 39 of 2004), Chapter 10, Section 89 of the National Health Act (Act 61 of 2003), Chapter 7, Section 28, 32, 33 and 34 of the National Environmental Management Act (Act 108 of 1998), Chapter 16, Section 151 of the National Water Act, and Chapter 7 Section 68 of the National Waste Management Act, including any other penalties contained in any By-Laws.
